Terms and Conditions
As a family run business, we have tried to keep the terms and conditions
as simple as possible. Whilst certain terms and conditions are necessary
for both parties, overall we try to maintain an approach of common sense and
courtesy between ourselves and the customer. If you have any concerns or queries
regarding the terms and conditions, please feel free to contact us. Many thanks.
- The Motorhome may only be driven by the persons named on the
Hire Agreement, providing they are in possession of a current valid driver’s licence
(valid for driving in New Zealand), and provided they are 25 years of age or over
(named drivers under the age of 25 are subject to an additional insurance excess).
- The Bond ($1,500) paid by the Hirer to the Owner will be held
by the Owner as security for the return of the Motorhome in a complete, undamaged,
reasonably clean condition; and as security for the payment of any sums (including
insurance excess, fines and late return liability) owed by the Hirer to the Owner.
- The Motorhome must be returned:-
- with a full tank of fuel (as it will be provided to you at the
beginning of the Hire). Should the Motorhome require oil or LPG
gas during the Hire, please keep the receipts for a full refund;
- with the toilet waste and grey waste tanks empty.
- The Hirer must:-
- ensure during the period of the Hire that:-
- Oil and water levels are checked regularly to be at serviceable
levels;
- the batteries are maintained at the proper levels;
- the tyres are maintained at their proper pressure (punctures
and tyre damage are the responsibility of the Hirer).
- use care and be mindful of the law when handling and parking
the Motorhome.
- leave the Motorhome securely locked when unattended.
- Neglect of all or any points in 4 above, makes the Hirer liable
for any subsequent damage, loss of use and costs of alternative arrangements.
- There is no insurance cover if an accident happens
when the Motorhome is being used by anyone:-
- who is under the influence of any intoxicating substance or drug;
- who has a proportion of alcohol in their blood or breath which
exceeds the legal limit;
- fails to supply a blood or breath sample as required by law;
- who does not stop after an accident as required by law;
- who is issued with a certificate of conviction under Section
58 or 58c of the Transport Act 1962 for an offence which was committed at the time
of the accident or following it. If the driver dies from injuries received in an
Accident, the proportion of alcohol in any blood sample taken from the body of the
deceased person will be assumed to be the same proportion which was in the blood
at the time of the accident.
- There is no insurance cover if the Motorhome:-
- is used in an unsafe or unroadworthy condition;
- is operated in any rally, speed contest, race or contest;
- is driven on any of the following roads - Balls Hutt Road (Mt
Cook), Ninety Mile Beach (Northland), North of Colville township (Coromandel Peninsula),
Tapu-Caroglen Road (Coromandel Peninsula), Skippers Road (Queenstown), Public ski
field access road when wheel chains are required, Private ski field access roads,
Coast Road to Russell (Bay of Islands), Crown Range Road (Queenstown) or on any
beach;
- is used in a way which contravenes any road regulations or bylaws
relating to road traffic;
- is used to propel or tow any other vehicle.
- If insurance is deemed invalid due to the actions of the Hirer,
the Hirer will be responsible for, and the Owner will pursue the Hirer for, any
and all costs relating to reinstatement of the Motorhome, including any costs relating
to loss of use (a copy of the full insurance policy is available on request).
- If the Motorhome requires repair through accident or breakdown,
or is involved in any accident, the Hirer shall advise the Owner of the full circumstances
immediately. The Hirer shall not arrange or undertake any repairs or salvage without
the authority of the Owner except to the extent that the repairs are necessary to
prevent further damage to the Motorhome or to other property or persons.
- Please return the Motorhome on (or before) the agreed time at
the agreed drop-off place; or contact the Owner should you wish to request a change
in the time or place. The Hirer will be responsible for any costs due to late return
or return to any other place not previously agreed.
- The Owner shall have the right to terminate the Hire and take
immediate possession of the Motorhome without compensation or refund of monies paid
if, the Hirer fails to comply with any of the terms and conditions of this Agreement
or if the Motorhome is damaged.
- New Zealand legislation provides limited coverage for personal
injury. We strongly recommend that all people travelling in New Zealand take out
Personal Travel Insurance.
